It all amounts to bad news for Lindsay Lohan after the actress has again failed a court-ordered alcohol test June 13--forced back to court June 23, facing a possible jail sentence in a probation violation hearing. In a step up, Lohan passed the drug test but failed the alcohol test which could land her back in a Los Angeles cell.
Lohan's already on house arrest, the actress is confined to her Venice Beach, California, home after a jail sentence imposed just last month in May 2011. The actress is slated to appear before Los Angeles County Superior Court Judge Stephanie Sautner at 10 a.m. on June 23 -- after testing positive for alcohol use on June 13.
Sautner is the same judge who doesn't seem to fond of the actress or her antics: The L.A. court judge ordered Lohan to a 120 days jail sentence after the actress recently pled guilty to stealing a necklace from a retail store.
As a non-violent offender, Lohan qualified for a home confinement program and reduced sentence. The in-house jail sentence is a workaround for Los Angeles that is intended to reduce overcrowding in the L.A. county jail system.
This time around may not prove to be a "home" run for Lohan: The actress may be thrown back in jail pending the outcome of the hearing. Recent media reports have displayed photos and reports of Lindsay Lohan and friends, socializing on the rooftop of her luxury home in L.A..
There seems to be some lies that may not prove leniency in the June 23 hearing for the actress. On June 18, 2011, Lohan told Life & Style magazine: "When my friends come over, they're not drinking. Alcohol is not in my house, so it's just not a part of my life." Five days prior Lohan had allegedly failed an alcohol and drug screening, testing required in accordance with her probation.
Even with drunk driving convictions and a growing list of probation violations -- in addition to the guilty plea over a recently-stolen necklace that resulted in a theft conviction -- Lindsay Lohan has repeatedly avoided jail for the most part. The actress has spent only days in jail despite all her legal troubles.
The Los Angeles County Sheriff's office issued statement that budget constraints and efforts to curb overcrowding in jails means nonviolent offenders with lesser crimes only get 20% of their sentence. And Lohan has proved that statement as tried and true. Maybe until now.
Lohan was expected to be released from home confinement next month in July -- but the June 23 hearing could land the actress physically in a jail cell. She's kind of running out of other options: The actress entered a drug rehab facility in May 2011, to avoid a jail sentence imposed by another L.A. judge. But Judge Sautner made it clear she didn't think drugs and alcohol were the source of Lohan's legal problems, stating: "She's [Lindsay Lohan's] got other problems for which she self-medicates."
It's been a long, hard four years of court-related troubles and Lohan also just tested positive for alcohol use, a violation of probation rules, in February 2011. The actress' drug test failure last August -- ending in a jail sentence and court-ordered rehab -- involved cocaine use and amphetamines.
